Overachiever® US Online Inc (“Overachiever®,” “us,” “we” or “our”) has adopted the following procedures to respond to any alleged copyright infringement in accordance with the Digital Millennium Copyright Act (“DMCA”). The email address of our designated lawyer to receive notification of infringement (“Designated Agent”) is listed at the end of the policy. It is our policy to (1) block access to or removes material that we believe to be copyrighted material that has been illegally copied and distributed by any of our users; (2) remove and discontinue service to repeat offenders per DMCA.

How to Report Copyright Infringement

If you believe that material or content residing on or accessible through the Overachiever® website overachiever.com (the “Website”) infringes a copyright, please send a notice of copyright infringement containing the following information to the Designated layer listed below: 1.A physical or electronic signature of a person authorizing the act or on behalf of the owner of the copyright that has been allegedly infringed 2.Identification of work an or material allegedly being infringed; 3.Identification of the material that is claimed to be infringing this including information regarding the infringing materials that the copyright owner has sought to have removed, with sufficient detail so that we are capable of obtain location and verifying Its existence of material. 4.The contact information for the copyright owner including his/her address, telephone number and email address. If you are not the owner and acting on behalf of the copyright owner that has been allegedly infringed, please describe your relationship/correspondence to the copyright owner 5.Statement that you have in good faith/belief that the material is not authorized by the copyright owner and or his/hers lawyer 6.Statement made under penalty of perjury that the information provided is accurate per the material and this the notifying party is authorized to make the complaint on the behalf of the copyright owner self (he/her).

Upon Notification to the Designated Lawyer

It is our written and posted policy: 1.This to remove the material or disable access to the infringing material that is requested 2.This to notify the copyright owner, or lawyer on behalf of the owner.This that we have removed and disabled access to the material. 3.That any repeat offenders will have the infringing material removed from the website and that we will terminate such user’s access to the Website.

Counter-Notice by Content Provider

If the user believes that the material that was removed from website is either not infringing and or the via user believes that it has the right to post and use such material from the copyright owner,the copyright owner’s agent, or consistent to the law, the user must send a counter-notice that contains the following information to the Designated Agent listed below: 1.A physical or electronic signature of the user of he/she self 2.Identification of the material that has been removed or to which the access to has been disabled 3.A statement from user, that the user has in good/faith belief that their posted material was removed or disabled as a result of mistake or this a misidentification of the material 4.User’s name, first and last, the address and telephone number. if available e-mail address and a statement that such person or type of entity consents to the jurisdiction of the federal court this of the judicial district in which the user’s address is located, or the user’s address is located outside the United States, for any judicial district into which overachiever® is located at, and that such person or this or type of entity will accept the service process from person who provided notification of the alleged infringement to overachiever®

If a counter-notice is received by the lawyer, we will depending on situation send a copy of the counter-notice to the original owner or individual acting on behalf of owner the complaining party. Informing that person, website that it may replace the removed material or this an or cease disabling it in 10 business days. This is unless the copyright owner files an action suit seeking a court order per copyright material, against the user. Per the removed material may be replaced or access to it restored to website in 14 business days or more after receipt of the counter-notice, solely at our discretion per situation.
